DONATEOPEN TERMS OF USE
Effective Date: 30 June 2025
- Definitions "Service" means the online platform operated by DonateOpen Co., available at https://donateopen.com, that enables Users to send one-off donations ("Donations"), launch fundraising campaigns and subscribe for monthly support. "Author" means a registered User who receives Donations through the Service. "Donor" means a User who sends a Donation to an Author. "User" means any individual who uses the Service, whether as an Author or Donor.
- Acceptance of the Terms By accessing or using the Service you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Service.
- Eligibility (18+) The Service is intended only for persons who are at least eighteen (18) years old and who have the legal capacity to enter into a binding contract.
- Description of the Service DonateOpen Co. provides a technology platform that facilitates Donations. We are not a bank, money-transmitter, charity or broker. All payments are processed by Stripe Connect, subject to Stripe's own terms.
- Registration, Verification and Accounts Registration is mandatory for Authors. Donators may send one-off Donations without creating an account. To withdraw funds an Author must successfully complete Stripe's Know Your Customer (KYC) procedure. DonateOpen Co. does not store copies of KYC documentation. You are responsible for safeguarding your account credentials.
- Payments, Fees and Payouts Donators pay no DonateOpen fees. Card and currency conversion fees charged by Stripe may apply. Authors pay Stripe's standard fees for each transaction and payout. The current fee schedule is available at stripe.com.
- Refund Policy All Donations are final and non-refundable, unless otherwise required by applicable law. Donators may, however, initiate a chargeback through their payment provider within 180 days of the transaction where permitted by the relevant card network.
- User Conduct You agree that you will not: Use the Service for any unlawful purpose, including money-laundering or financing of terrorism; Post or transmit content that is hateful, harassing, defamatory, pornographic, violent, or otherwise prohibited; Engage in spam, phishing, or distribute malware; Violate any third-party rights. We may suspend or terminate your account and remove content at our sole discretion for violations of these Terms.
- Personal Data & Privacy We collect only the minimum personal data: e-mail address, display name and Stripe account ID. For Users located in the European Economic Area (EEA), United Kingdom or Switzerland we process personal data in accordance with the EU and UK General Data Protection Regulation (GDPR). For California residents we honour rights under the California Consumer Privacy Act (CCPA). Full details are provided in our Privacy Policy, which forms part of these Terms. You may request deletion of your personal data at any time.
- Intellectual Property Users do not upload content through the Service. All rights in the DonateOpen name, logo and platform belong to DonateOpen Co.
- Disclaimer of Warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.
- Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, DONATEOPEN CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- Indemnification You agree to indemnify and hold harmless DonateOpen Co., its directors, employees and agents from any claim, damage or expense arising out of your breach of these Terms or violation of any law.
- Termination We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.
- Changes to the Service and to the Terms We may modify these Terms or introduce new features-including recommendation and ranking services-at any time. We will notify you by e-mail or by posting the updated Terms at least 14 calendar days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
- Governing Law and Dispute Resolution These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute shall be submitted to the exclusive jurisdiction of the state or federal courts located in Delaware. If you are a consumer resident in the EEA, you may be entitled to bring proceedings in your local courts and to rely on mandatory consumer protection rules of your country. The European Commission also provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
- Miscellaneous If any provision of these Terms is held to be invalid, the remaining provisions will remain in full force. No waiver of any term shall be deemed a further waiver of any other term.
